Confidentiality FAQ
Common questions about EAP privacy and confidentiality
Will my employer know if I use the EAP?
No. Your employer only receives aggregate utilization reports showing how many employees used the program, not who used it or why. Your individual use is completely confidential.
Are there any exceptions to confidentiality?
Yes, there are very limited legal exceptions: imminent risk of harm to self or others, suspected child or elder abuse, or if records are subpoenaed by court order. Counselors will inform you if any exception applies.
Can my manager refer me to the EAP?
Yes, managers can suggest EAP services, but they cannot require you to use them. If you do use EAP after a referral, the manager will not know whether you actually accessed services or what was discussed.
Are family members' sessions confidential too?
Yes. When family members use EAP services, their sessions are just as confidential as employee sessions. Information is not shared between family members without explicit consent.
How long are records kept?
EAP records are typically kept for 7 years as required by law, but they remain confidential and separate from employer records throughout this period and beyond.
Can I use EAP for issues with my manager or workplace?
Absolutely. Many employees use EAP to discuss workplace challenges, including difficulties with managers. These conversations remain confidential and can help you develop strategies for addressing workplace issues.
